Welcome to Digital Manager. By using our website, services, or WhatsApp Business API platform, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.
1. User Responsibilities
Users must use the platform and all services provided by Digital Manager only for lawful and legitimate business purposes.
Users are strictly prohibited from engaging in any fraudulent, deceptive, or misleading marketing practices.
All users must ensure that their usage complies with Meta’s WhatsApp Business policies and relevant local regulations.
2. Account Security
Users are fully responsible for maintaining the confidentiality of their account credentials, including login information and API access tokens.
Any unauthorized access or suspicious activity must be reported to Digital Manager immediately.
We are not liable for any loss or damage resulting from failure to safeguard account information.
3. Payments and Billing
Users agree to pay all subscription fees, service charges, or one-time payments in a timely manner as per the agreed pricing.
Failure to make timely payments may result in suspension or termination of access to services.
All fees paid are non-refundable, except where explicitly stated in writing.
4. Data Protection
Users must obtain explicit consent from their end-users before sending any marketing or transactional messages via WhatsApp using our platform.
Users agree to comply with all applicable data protection and privacy laws, including but not limited to the Information Technology Act, 2000 (India) and GDPR if applicable.
Digital Manager is not responsible for any violations of privacy laws by users of the platform.
5. Compliance with Meta Policies
Users must adhere strictly to Meta’s WhatsApp Business API Terms of Service, policies, and technical guidelines.
Violation of Meta’s rules or misuse of the API may lead to suspension or permanent termination of services by Meta or Digital Manager without prior notice.
6. Service Modification & Termination
Digital Manager reserves the right to modify, suspend, or discontinue any part of the service at any time without prior notice.
We may terminate access to services for violations of these Terms or applicable laws, or at the request of Meta.
7. Limitation of Liability
Digital Manager shall not be held liable for any indirect, incidental, or consequential damages, including loss of data, revenue, or business opportunities arising from the use or inability to use the platform.
8. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India, with jurisdiction in the courts of Ahmedabad, Gujarat.
